What happened

The U.S. National Highway Traffic Safety Administration has reached an agreement with SAE to launch ASCEND, a government-industry initiative meant to accelerate the development of data-driven performance standards for autonomous vehicles. According to TechCrunch, the announcement came as NHTSA works on a broader federal automated vehicle framework, and it is the most concrete step yet toward answering a question that has so far been left largely to the companies building the technology: how do we know when a self-driving system is safe enough for public roads?

A driver's test with no equivalent

TechCrunch highlights the core gap: human drivers must pass a licensing exam, but there is no standardized, real-world test for judging how well an automated driving system performs. Federal motor vehicle safety standards already govern the vehicles automakers sell, yet those rules were written around conventional equipment — pedals, steering wheels, side mirrors, rearview mirrors — that purpose-built robotaxis such as the Tesla Cybercab and the Zoox vehicle simply do not have.

How NHTSA is framing it

NHTSA Administrator Jonathan Morrison, speaking at the AI Horizons Summit in Pittsburgh, said the agency wants a framework that puts safety at the foundation without stifling innovation, and that avoids forcing regulators into playing "whack-a-mole" with policy decisions or trying to predict how the technology will evolve.

Morrison said the consortium's top priority is automated driving system (ADS) competency, which is intended to inform and speed up a corresponding federal motor vehicle safety standard. He added that an AV competency standard could help resolve what he described as a growing patchwork of inconsistent state and local requirements, while supporting American innovation and safe deployment.

No clock on the work

As TechCrunch notes, no timeline has been given for when ASCEND will actually produce ADS standards, and the outlet suggests industry input is already well underway. That leaves an open-ended period in which the question of AV safety remains effectively self-answered by developers applying their systems to self-driving trucks, robotaxis and, eventually, perhaps privately owned passenger cars.

Deployment is not waiting for the rulebook

The standard-setting effort is running alongside rapid commercial expansion, also covered by TechCrunch. Zoox, which operates a commercial robotaxi service in Las Vegas, has been limited to 100 vehicles there, a cap that expires September 25 and clears the way for its custom-built fleet to grow. Waymo has restarted its San Antonio service five months after one of its vehicles was swept away in a flash flood, launched a new robotaxi service in Las Vegas, and said it will begin mapping and testing in Singapore. May Mobility, which runs autonomous Toyota Siennas in three locations, plans to go public through a merger with SPAC ACP Holdings Acquisition Corp., a deal TechCrunch reports could raise more than $300 million at a $1.4 billion valuation and would make it the first U.S. public company focused entirely on autonomous ride-hailing.

Why it matters

Certification is the gating question for autonomous vehicles at scale. Right now, the judgment of whether an AI-driven driving system is safe enough rests mostly with the companies selling it, backed by an inconsistent mix of state and local rules. A federal ADS competency standard would give regulators, insurers and the public a common yardstick — the AV equivalent of a driver's test — and would determine how quickly steering-wheel-free vehicles can reach the mass market. The stakes cut both ways: rules that are too strict could stall a nascent industry, while rules that are too loose could force a reckoning after a high-profile failure. With fleets already expanding across U.S. cities and beyond, the window in which deployment outruns certification is closing from both directions, and ASCEND's still-undefined timeline is itself part of the story.
